Wellness Circle Membership Agreement

This is the wording you accept when you join. Read it now if you'd rather not read it mid-signup. It's a public page on purpose, so you can send it to a colleague, your insurer or your registration body without asking us for a copy.

The short version, in plain English

This summary isn't the agreement. The formal wording below is what you're accepting. But you shouldn't have to read nine numbered clauses to know what you're walking into.

  • We don't check anyone's qualifications, registration or insurance, and we don't pretend to. Checking a practitioner's credentials is your call to make, the same as it would be anywhere else.
  • What's said inside stays inside. Don't repeat it, don't copy the directory, don't build a marketing list out of it.
  • You can leave whenever you like, from your own account page. No email, no phone call.
  • Brands don't sell in community spaces. Promotions live in their own area and a person reads them first.
  • Nothing here is medical advice, and nothing here replaces your professional body, your supervisor or your insurer.
  • New Zealand law applies, and the consumer rights you have at home in Australia or the UK still stand alongside it.

Please read this Membership Agreement before you enter the members area. By ticking the "I Agree" box, you enter into a binding agreement with The Wellness Circle ("we", "us", "the Organiser").

1. Who this is between, and what it's for

  • Us: The Wellness Circle, the organiser of this members association.
  • You: the individual or entity registering for access to the Wellness Circle network.
  • The Circle: a private, cross-border members association for natural health networking, peer education and brand awareness.

2. Member types, free entry and optional upgrades

When you register you choose the member type that best describes why you're here. Every new practitioner and wellness brand starts with a free Community membership. Additional tools and capacity can be added later from inside the members area.

  • Practitioners: a member profile and the Community tools available to support their own client group.
  • Clients: access only to the private spaces they have been invited into, unless they separately join as a member.
  • Wellness brands: a member profile and Community access, with brand training and promotion tools available on eligible upgrades.
  • Free membership: creating an account and accepting this agreement opens the Community membership without a card or joining fee.
  • Optional upgrades: if you later choose a paid plan, you agree to the price and billing interval shown inside the members area before checkout.
  • Free trial: if you're paying us directly on a monthly membership, your first 30 days are free. We take your card details at signup but don't charge them during the trial. At the end of the 30 days your card is charged the monthly fee shown at checkout, and monthly billing continues from there. Cancel any time before the trial ends and you won't be charged. One trial per person, and it isn't available on yearly memberships or where your ClientWell plan already covers the Circle.
  • Billing: fees are charged automatically each month or each year to the payment method you give us. Yearly is twelve months for the price of ten.
  • Currency: fees are processed in NZD, or in AUD if you select Australia at checkout.
  • Cancelling: you can cancel any time from your account page. Cancelling stops the next charge and your access runs to the end of the period you've paid for.
  • Refunds: to the extent permitted by law, fees already paid are not refunded, except where we've told you otherwise. For example, if we charged you for a membership your ClientWell plan already covered, we'll refund it.
  • Some members pay us nothing because their ClientWell plan includes the Circle. This agreement still applies to them in full.

3. How we behave in here

Two of these matter more than the rest, so they come first.

  • Scope of practice: practitioners work strictly within the modalities they're qualified in, and don't diagnose or treat outside them.
  • No medical advice: everything shared in the Circle is general, educational and for networking. It doesn't replace professional diagnosis, advice or treatment.
  • Respect: no harassment, discrimination, defamatory remarks or predatory outreach. There's no second warning for this one.

4. No selling inside community spaces

  • No transactions in the platform: no checkouts, no order taking, no selling of physical or digital products inside the workspace.
  • Promotions: brands and practitioners can link out to their own sites and storefronts, but only in the channels set aside for that. Unsolicited private messages for sales purposes are not allowed.

5. Privacy and confidentiality

  • Peer confidentiality: members share real health journeys and real business detail in here. Keep what other members share to yourself.
  • No scraping: don't extract, harvest or collect member details or the directory for external marketing.
  • Off-platform for clinical matters: specific client-practitioner consultations and sensitive health disclosures belong in a secure private channel outside the Circle. We ask you to move those conversations off the platform because we can't make this a clinical record system, and we won't pretend it is one.

6. What we don't do, and what you take on

We don't verify practitioners' qualifications, registrations, insurance or professional standing before they join. Membership is not an endorsement of anyone's skill, safety or suitability for you. Checking a practitioner's credentials before you book or take advice is your call to make.

  • Your own risk: members take part in wellness discussions, gatherings, diets and exercise at their own risk.
  • Our role: we host the network. We're not liable for the quality, safety, accuracy, legality or effectiveness of advice, services or information shared by members.
  • Your statutory rights: nothing here excludes, restricts or modifies a consumer guarantee or right you have under the law where you live. That includes the New Zealand Consumer Guarantees Act 1993 and Fair Trading Act 1986, the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010), and the UK Consumer Rights Act 2015. Where a term here conflicts with those rights, those rights apply.

7. Starting and ending

  • Start: this agreement begins when you accept it. Any later paid upgrade begins when its payment is confirmed.
  • Leaving: cancel your subscription before your next billing date and this agreement ends with it.
  • Removal: we can suspend or end your membership immediately, without notice or refund, if you breach the conduct or commercial terms above.

8. Which law applies

This agreement is governed by the laws of New Zealand, and members submit to the non-exclusive jurisdiction of the New Zealand courts. Non-exclusive means you can still bring a claim in your own country where the law where you live gives you that right.

If you live in Australia or the United Kingdom, choosing New Zealand law does not take away the consumer protections you have at home. Those rights sit alongside this agreement, as set out above.

9. Your acceptance, on the record

When you tick the box labelled "I have read and agree to the Membership Agreement", you confirm you've read it, understood it, and agree to be bound by it. We record the version number and the date against your account, and this page stays public so you can read it, print it, file it with your CPD records, or send it to your registration body without asking us for anything.

When you accept, we save a record of the agreement version, the date, and your account details. That's just so we both know what was agreed.
